No CBI probe into nun’s rape case at this stage: SC

NEW DELHI: The Supreme Court on Wednesday declined to order a CBI probe into the rape of a nun during anti-Christian violence in Orissa. The apex cou
rt, however, asked the BJD-BJP government in the state to set up fast-track courts to expeditiously try communal violence cases.

A bench comprising Chief Justice K G Balakrishnan, Justice P Sathasivam and Justice J M Panchal said: “At this stage, we do not think it is proper to hand over the investigation into the case from the state police to the CBI. In the interest of the victim as well as in the interest of justice, the victim will cooperate with the state police.”

The court, however, said that the communal violence related cases would be tried expeditiously by setting up fast-track courts. It also asked the state government to take a generous view on rebuilding damaged churches.

“The government shall take a generous view on the matter to assess the damage and assist in rebuilding them”, court said. The government, however, in its affidavit had said: “Compensation towards religious institutions is not coming (does not come) under the secular policy of Orissa government.”

The court further said that the Centre should not withdraw paramilitary forces stationed at the riot-hit areas till December-end in view of the upcoming Christmas.

It said that members of the NGOs and volunteers appointed by church can be included into the state-appointed committee looking after rehabilitation of victims and they should be provided protection by central forces.

However, while declining the plea for a CBI probe into the rape case, the bench noted it cannot pass any direction to make the victim, who has left the area and was refusing to participate in the Test Identification Parade, to comply. “The victim is not cooperating with the police in the investigation. We cannot force her for TIP. We cannot pass any direction in such a case.”
